My Story

Part I,
Harley v. Nesby, Harper

Singer Ann Nesby and DJ Vaughn Harper are being sued by Singer/Songwriter/ProducerPeggy Harley for the alleged theft of her composition entitled “It Will NeverHappen Again.” Harley states that the song “I Apologize,” is a complete rip offand infringement of her Copyrighted Work “It Will Never Happen Again” and that the two songs are ideally one. The Songstress Peggy Harley says that Harper put her song in the hands of Nesby when she refused his offer to become a part of his tribute album because Harper told her that he “didn’t want to get attorneys involved.” Harley also states that Nesby and her staff and Harper where involvedwith dissecting the song for Nesby and that both Nesby and Harper have “Access” to ten of her Copyrighted Works that she believes Harper may be placing with other recording artists without her consent. According to documents, 4: AM Records had already began to promote “It Will Never Happen Again” when Harper’s actions counter acted their marketing campaign strategy, causing the company to lose money and audiences by granting “Access” to Nesby before the album was nationally released.

To worsen matters, Ms. Harley’s fiancé, the love of her life, whom “It Will Never Happen Again” was written for, was told by doctors that he only had a short time to live.That is when 4: AM Records pulled the commercials for the song from the airwaves to allow time for her fiancé to recuperate. “We were praying that the love of my life would recover. We expected to release the song in late 2007 when he was better but Ann Nesby beat me to the release of my own song. Unfortunately, that never happened, he never recover. He died a little over 6 month ago in June of 2007. Shortly after his death I heard “I Apologize” on the radio. It was more than I could handle at the time, so I packed my bags and left the city to get away. So much of my song has been stolen; it would be difficult to present “It Will Never Happen Again” to the world as a fresh concept” Harley explained.
